Terms of Service

These terms are the agreement between you and Marque. They cover what you can expect from the app, what we expect from you - above all, on the road - and the limits of what we're responsible for. Please read the safety and liability sections properly; they matter more than the rest.

Agreeing to these terms

By creating a Marque account or using the app, you agree to these terms. If you don’t agree, don’t use Marque. Marque is operated by Tomáš Krčál (“Marque”, “we”, “us”), and you can reach us any time at support@getmarque.club.

Who can use Marque

You must be at least 16 years old to create an account. You may only record a drive as the driver if you hold a valid licence for the vehicle and the road you’re on, and the vehicle is legal to be there. You’re responsible for everything that happens under your account, so keep your sign-in details to yourself.

Driving, and your responsibility for it

This is the most important section in this document. Marque is a logbook, not an instruction. It records what you did after you did it. Nothing in the app - no metric, no badge, no board, no comparison with another driver - is a target, a challenge, or an invitation to drive in any particular way.

• You must obey the law, always. Follow the speed limits, traffic laws, and road rules wherever you are. They override anything you see in Marque, without exception.
• Don’t use your phone while driving. Set up your drive before you move off. Recording runs on its own with the screen off - there is never a reason to touch your phone mid-drive, and doing so may itself be illegal where you are.
• Save the limits for the track. Speed, acceleration, and cornering figures shown in Marque are a record of your driving, not a score to beat. Marque does not condone, encourage, or reward speeding, racing, or any dangerous driving on a public road.
• How you drive is your decision alone. You are solely responsible for your driving, your vehicle, your passengers, and your compliance with the law - whether or not Marque is running, and whatever the app happens to show you.
• Never rely on Marque for safety. GPS traces, speeds, and derived figures are approximate and can be wrong, late, or missing. Don’t use them to judge anything that matters in the moment.

Where Marque compares your drive with another driver’s, or ranks drives against one another, those features score composure - smoothness, cornering, and the absence of violent inputs. They do not score speed, and driving faster cannot improve your position; if anything it lowers it, because going harder means rougher inputs. There is nothing on any Marque ranking to be won by driving quickly. Some things Marque shows are descriptions, not contests: a profile may note the character of a drive - how much cornering load it carried, say - but that is a record of what the car did, never a score, never part of a ranking, and never a target to chase. Any feature that ranks on pace is limited to closed circuits and private land, where driving quickly is lawful, and using such a feature on a public road is a breach of these terms.

Marque does not police your driving, and it does not withhold your own data from you. It records what you did and shows it back to you. That is not permission, and it is not encouragement: the responsibility for how you drive is entirely yours, and the fact that Marque logged something has never meant that Marque approved of it.

You use Marque, and you drive, at your own risk. Driving carries inherent risk of injury, death, and damage, and that risk is yours - we do not assume it and we cannot reduce it.

Your content

Your drives, vehicles, builds, photos, and profile are yours; we claim no ownership of them. You give us only the permission we need to run the service - to store your content, and to display it to the people you choose to show it to. When you publish a drive or build, you’re asking us to make it reachable by anyone with the link, and (if you also list it) to surface it in Explore. Make that content private again and we’ll stop serving it.

Only upload things you have the right to upload, and don’t publish other people’s personal information - including routes and locations that would expose where somebody else lives.

Things you must not do

• Break the law, or use Marque to plan, coordinate, or celebrate breaking it - including street racing.
• Falsify drive data, or upload traces you didn’t record yourself.
• Harass, impersonate, threaten, or abuse anyone.
• Upload content that’s unlawful, hateful, or infringes someone else’s rights.
• Attack, probe, overload, or reverse-engineer the service, or scrape it in bulk.
• Resell or redistribute Marque, or access it through anything other than our own apps.

We may suspend or close an account that breaks these rules, and we’ll remove content that does. Where the law requires it, we’ll report it.

Subscriptions and payment

Marque is free to use, with an optional paid subscription that unlocks additional features. Subscriptions are sold and processed by Apple or Google, not by us - we never see your payment details.

• Prices are shown in the app by the store, in your local currency, before you buy.
• Subscriptions renew automatically until you cancel. Cancel any time in your App Store or Google Play account settings - deleting the Marque app, or your Marque account, does not cancel it.
• Refunds are handled by the store under its own policy. If you’re an EU/EEA consumer you also have a statutory right of withdrawal; the store handles that too, and we’ll help if you get stuck.
• We may change what’s in the paid tier or what it costs - we’ll tell you before a change affects you.

Your privacy

What we collect and why is set out in the Privacy Policy, which forms part of these terms. You can delete your account from inside the app, or read Delete your account and Delete your data.

The service is provided “as is”

We work hard to make Marque good, but we can’t promise it will always be available, uninterrupted, or free of errors, or that any figure it shows you is accurate. GPS is imprecise, phones fail, and drives can be lost. To the extent the law allows, Marque is provided as is, without warranties of any kind. Keep your own copy of anything you can’t afford to lose.

We may change, suspend, or discontinue features - including the paid tier - and we’ll give reasonable notice where a change materially affects you.

Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you’re a consumer, your mandatory statutory rights are unaffected by anything below.

Subject to that, and to the fullest extent permitted by law:

• We are not liable for how you drive, or for any accident, collision, injury, death, damage, fine, penalty, prosecution, or loss of licence arising out of your driving, your vehicle, or your use of a road - whether or not Marque was recording, and whatever the app showed you before, during, or afterwards.
• We are not liable for the conduct of other users, for content they publish, or for anything that happens when you choose to drive a route another user shared.
• We are not liable for indirect or consequential loss, or for lost data, lost drives, or lost profits.
• Where we are liable, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or EUR 50.

Indemnity

If someone brings a claim against us because of the way you used Marque - how you drove, what you published, or a law you broke - you agree to cover the reasonable costs and damages we incur as a result, except to the extent it was our fault.

Ending it

You can stop using Marque and delete your account at any time, from inside the app. We may suspend or close your account if you break these terms, if we’re required to by law, or if we discontinue the service - and other than for a serious breach, we’ll give you notice and a chance to get your data out. The sections that should outlive the agreement - your content, liability, indemnity, and governing law - survive it.

Governing law

These terms are governed by the laws of the Czech Republic, and disputes fall to the Czech courts. If you’re a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you can always bring proceedings there. EU consumers can also use the European Commission’s online dispute resolution platform.

Changes

We may update these terms as Marque evolves. We’ll revise the “Last updated” date above and, for material changes, tell you in the app or by email before they take effect. Carrying on using Marque after that means you accept the new terms.
